These general terms of use (the “Terms”) govern access to and use of the site www.permatan.fr (the “Site”), published by INVEST VALOR FRANCE SAS, a simplified joint-stock company with a share capital of €10,000, whose registered office is at 55 avenue Marceau, 75116 Paris (France), registered with the Paris Trade and Companies Register under number 794 191 007 (EU VAT FR57 794191007), operating the PERMATAN® brand.

1. Acceptance of the Terms

Accessing and browsing the Site constitutes unreserved acceptance of these Terms. If you do not accept them, it is up to you not to use the Site. Sales concluded on the Site are, for their part, governed by the General Terms and Conditions of Sale accessible from the footer.

2. Access to the Site

The Site is freely accessible to any user with an internet connection, connection costs remaining at the user’s expense. INVEST VALOR FRANCE uses reasonable means to ensure continuous access to the Site, without being bound by an obligation of result: access may be suspended at any time, in particular for maintenance, updates or any other technical reason, without the publisher incurring any liability.

3. Customer account

Creating a customer account allows you, among other things, to track your orders. Log-in is by means of a verification code sent by email. The user undertakes to provide accurate, up-to-date information and is solely responsible for the use of their account and for the confidentiality of their mailbox. Any fraudulent use must be reported without delay to the contact address above. The publisher reserves the right to suspend an account where these Terms are not complied with.

4. Trade area

An area dedicated to trade customers is available on request. Opening a trade account is subject to approval by INVEST VALOR FRANCE, which reserves the right to refuse or close an account without having to give reasons. The trade prices shown in that area are confidential and may not be disclosed to third parties.

5. Intellectual property

The PERMATAN® trade mark, the domain name, the logos, texts, photographs, illustrations and all other content on the Site are protected by intellectual property law and remain the exclusive property of INVEST VALOR FRANCE or its licensors. Any reproduction, representation, modification or exploitation, in whole or in part, without prior written authorisation is prohibited and constitutes infringement within the meaning of articles L.335-2 et seq. of the French Intellectual Property Code.

6. Content and information

PERMATAN® products are cosmetic products intended to even out the appearance of the skin. The information published on the Site is provided for information only: it in no way constitutes medical advice and is not a substitute for consulting a healthcare professional, in particular for the diagnosis or monitoring of vitiligo or any other skin condition.

7. Personal data and cookies

The processing of users’ personal data is described in the Privacy Policy accessible from the footer of the Site, in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act. The Site uses cookies or trackers for operational purposes, audience measurement and, where applicable, marketing; users may configure them in accordance with the Privacy Policy.

8. Liability

The user acknowledges that they use the Site under their sole responsibility. INVEST VALOR FRANCE may not be held liable for indirect damage resulting from use of the Site, in particular in the event of interruption, malfunction, loss of data or the presence of viruses, subject to mandatory statutory provisions. As the hypertext links on the Site may lead to third-party sites, the publisher accepts no responsibility for their content.

9. Amendment of the Terms

INVEST VALOR FRANCE reserves the right to amend these Terms at any time. The applicable version is the one published on the Site on the day it is used.

10. Governing law and disputes

These Terms are governed by French law. In the event of a dispute and failing an amicable settlement, the French courts shall have jurisdiction under ordinary law. Consumers are informed that they may resort to conventional mediation or to any alternative dispute resolution method, under the conditions set out in the General Terms and Conditions of Sale.
