Terms of sale
1. Introduction
These terms of sale are entered into, on the one hand, by the company INVEST VALOR France sas, with a share capital of €10,000, registered office: 55 avenue Marceau, 75116 Paris (France), SIRET: 794 191 007 00044 , hereinafter “PERMATAN®” and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.permatan.fr, hereinafter “the Buyer”.
These terms of sale are intended to define the contractual relationship between PERMATAN® and the Buyer and the terms applicable to any purchase made through PERMATAN®’s online store, whether the Buyer is a business or a consumer. Acquiring goods or services through this site implies unreserved acceptance by the Buyer of these terms of sale.
These terms of sale shall prevail over any other general or particular terms not expressly agreed by PERMATAN®.
PERMATAN® reserves the right to amend its terms of sale at any time. In that case, the applicable terms shall be those in force on the date of the Buyer’s order.
Characteristics of the goods and services offered
The products and services offered are those appearing in the catalogue published on PERMATAN®’s site. These products and services are offered while stocks last. Each product comes with a description prepared by the manufacturer; the Buyer may have access to the manufacturer’s documentation.
The photographs in the catalogue are for guidance only and are not contractual.
2. Prices
The prices shown in the catalogue are inclusive of tax, in euros, taking account of the VAT applicable on the day of the order; any change in the rate may be passed on to the price of the products or services. PERMATAN® reserves the right to change its prices at any time, it being understood, however, that the price shown in the catalogue on the day of the order shall be the only one applicable to the Buyer. The prices shown do not include delivery charges: these are invoiced separately and shown to the Buyer before the final validation of the order.
Please note that if an incorrect and manifestly derisory price is displayed, for whatever reason (software bug, manual error, technical error), the order, even if validated by us, will be cancelled, and we will inform you as soon as possible. You will then be able, if you wish, to place your order again at the corrected, accurate price.
Online sale of the products and services presented on the site is reserved for buyers residing in the countries on the published list and for deliveries requested within those geographical areas.
A Buyer wishing to purchase a product or service must:
- Complete the identification form giving all the details requested, or provide their customer number if they have one,
- Complete the online order form giving all the references of the products or services chosen,
- Validate their order after checking it,
- Make payment under the terms provided for,
- Confirm their order and payment. Confirmation of the order entails acceptance of these terms of sale, acknowledgement of full knowledge of them and waiver of the right to rely on the Buyer’s own purchasing conditions or any other conditions. All the data provided and the recorded confirmation shall stand as proof of the transaction. Confirmation shall stand as signature and acceptance of the operations carried out. The seller will send confirmation of the recorded order by email.
In accordance with articles L.221-18 et seq. of the French Consumer Code, a consumer Buyer has fourteen (14) days from the date of delivery of their order to return any item that does not suit them.
No withdrawal will be accepted if the returned product is unfit for resale. The product must therefore be returned in perfect condition, in its original packaging, unopened, unsealed, undamaged and unmarked.
The product must be accompanied by all its accessories and by a copy of the purchase invoice. Failing that, the product will be returned to the Buyer at the Buyer’s expense.
Returns will not be accepted if the return request is out of time or if the original packaging has been unsealed, opened, torn or marked.
Processing of withdrawal returns: the refund is made using the payment method used for the order, no later than fourteen (14) days after receipt of the returned product or proof of its dispatch. With the Buyer’s express agreement, the refund may take the form of a credit voucher.
Payment is due at the time of ordering.
Payments shall be made by bank card; they will be processed through the secure payment system Shopify Payments and/or PayPal, which use TLS/SSL encryption so that the information transmitted is encrypted by software and no third party can read it while it travels across the network.
At the Buyer’s request, a paper invoice showing VAT will be sent to them.

Delivery to your address by Colissimo. Whichever delivery method you choose, you can track your parcel online on the carrier’s website.
Delivery charges cover packaging, handling and postage. They may include a fixed part and a variable part depending on the price or weight of your order. We advise grouping your purchases into a single order. We cannot merge two separate orders and you will have to pay the delivery charge for each of them. Your parcel is shipped at your own risk; particular care is taken with parcels containing fragile products.
Parcels are generously sized and protected.
Deliveries are made to the address given on the order form, which may only be within the agreed geographical area. Risk passes to the Buyer from the moment the products leave PERMATAN®’s premises.
In the event of damage during transport, a reasoned complaint must be made to the carrier within three days of delivery. Delivery times are given as a guide only; if they exceed thirty days from the order, the contract of sale may be terminated and the Buyer refunded.
Delivery charges:
Delivery charges depend on the delivery method chosen by the Buyer and are calculated on the order as a whole. They are shown to the Buyer at the end of the order, before the Buyer confirms it.
Where a refund is requested for an order that has already been delivered, only the returned goods will be refunded: the delivery charge, having been “used up” to get the parcel to you, will not be refunded under any circumstances. Once the statutory withdrawal period has passed, PERMATAN® reserves the right to accept or refuse a request for exchange or refund made by the customer. Indeed, if the product purchased is free of hidden defects, the seller is not obliged to take it back. The seller may rely on the binding force of the contract of sale to treat the sale as firm and final and to reject any request for a refund from the customer. A customer who has made a mistake in their order or in the delivery address has no right to obtain a refund by returning the product.
Buyers are reminded that any goods that have been unsealed or bear marks of trial, use or wear will be systematically refused, especially where the products come into direct contact with the skin. The buyer must return the goods in their original condition and packaging.
Where goods held by the carrier (post office or distribution point) are not collected within the time allowed, the delivery charge is not refunded and a flat fee of TWELVE EUROS will be charged to cover case handling, inspection of the goods and return to stock.
Once the goods are back at our premises, we will inspect their condition and, after reviewing your case, we will let you know whether we agree or not, along with the procedure to follow.
EXPORT DELIVERY
Should the recipient refuse to pay import customs duties, our general terms and conditions of sale provide that payment for the order is not refunded. We do not accept the goods back, as they cannot be resold given the fragility of a dermocosmetic product that has undergone significant temperature changes in storage and handling conditions beyond our control.
All products supplied by the Seller benefit from the statutory guarantee of conformity provided for in articles L.217-3 et seq. of the French Consumer Code (a period of two years from delivery, repair, replacement or, failing that, a price reduction or rescission of the sale, at no cost to the Buyer) as well as from the guarantee against hidden defects provided for in articles 1641 et seq. of the French Civil Code. Where a product sold is not in conformity, it may be returned to the Seller, who will take it back, exchange it or refund it. All claims and requests for exchange or refund must be made by post to the following address: PERMATAN® – 55 avenue Marceau 75116 PARIS (France) within thirty days of delivery.
In the online sales process, the Seller is bound only by an obligation of means; it may not be held liable for damage resulting from use of the internet, such as loss of data, intrusion, viruses, service interruption or other unintended problems.
10. Intellectual property
All the elements of PERMATAN®’s site are and remain the exclusive intellectual property of PERMATAN®.
No one is authorised to reproduce, exploit, redistribute or use in any capacity whatsoever, even partially, any elements of the site, whether software, visual or audio. Any link, simple or hypertext, is strictly prohibited without the express written agreement of PERMATAN®.
PERMATAN® - Dermask® - COSMEDEV® - INOPROPIG® are trade marks registered with the INPI in Paris.
Buyers’ personal data are processed in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act, under the conditions described in the Privacy Policy accessible from the footer of the site. They are not passed on to third parties for commercial purposes without the Buyer’s consent.
Every Buyer has rights of access, rectification, erasure, objection, restriction and portability over their data, which they may exercise by writing to sales@permatan.fr. They also have the right to lodge a complaint with the CNIL, the French data protection authority.
PERMATAN® will archive order forms and invoices on a reliable, durable medium constituting a faithful copy in accordance with article 1379 of the French Civil Code. PERMATAN®’s computerised records shall be regarded by the parties as evidence of the communications, orders, payments and transactions between them.
These online terms of sale are governed by French law. In the event of a dispute and failing an amicable settlement, the French courts shall have jurisdiction under ordinary law; a consumer Buyer may bring proceedings, at their choice, before one of the courts having territorial jurisdiction under the French Code of Civil Procedure or before the court of the place where they were living when the contract was concluded.
In accordance with articles L.612-1 et seq. of the French Consumer Code, a consumer Buyer may use a consumer mediator free of charge with a view to the amicable resolution of any dispute with the Seller, after first making a written approach to sales@permatan.fr. They may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.
